Casey Anthony Neglected Reporting Caylee Missing, Jury Turns Blind EyeCasey Anthony was found guilty of lying to the police yesterday, that’s it.  Defense attorney Jose Baez did the jig; Prosecutor Jeff Ashton handed in his retirement papers and the evening news became engulfed in the flames of debate after the jury announced their decision in the Casey Anthony trial.
The majority of experts, reporters and professionals agreed that the prosecution overshot the charges when they asked for 25 year-old Casey Anthony to receive the death penalty if she was found guilty of murdering her 2 year-old daughter Caylee Marie Anthony back in 2008.  Asking for the death penalty meant that the prosecution needed to prove that 2-year-old Caylee Marie Anthony was murdered by her mother, Casey Anthony.  Moreover they needed to prove that Caylee did not drown in the pool, that the duct tape was placed over the little girl’s mouth by the fingers of her mother and any forensic evidence presented needed to say “Yes, chloroform was found in the trunk of Casey Anthony’s Pontiac” regardless of who performed it.
The Casey Anthony trial was certainly a massive media attraction however lacked an eyewitness and indisputable evidence which conveniently allowed the inexperienced defense attorney to be as organized as he wished.  Basically the trial was over before it even started because the prosecution’s presentation was doomed to fail as it would not provide the stone cold evidence that proved Casey Anthony was the one who murdered Caylee.
Fox News anchor Geraldo Rivera, landed an interview with defense attorney Jose Baez, where Baez agreed that the prosecution pursuing the death penalty benefited his client.   Rivera appeared on the O’Reilly Factor, where Fox News Host Bill O’Reilly opened up the argument within the first minute after Rivera claimed there was no evidence that Casey Anthony ever neglected her child in anyway.  O’Reilly was all over it, definitely going with the political grandstand as he sided with the majority on the issue?  But can you blame the guy?  I am sure I was not alone among the viewing public furious as they watched Geraldo Rivera make that statement.

How could you ever say that Casey Anthony was not neglectful?  Isn’t she the same mother who allowed her child to go missing without calling 911?  The best part of the entire interview was next as Geraldo Rivera struggled to regain his footing claiming that Bill was confusing two issues, what happened before the child went missing and what happened after June 16th 2008.  But really Geraldo Rivera should have just admitted he was wrong rather than firing back with more what if’s. were failing to see  claimed that pursuing the death penalty was a Conversation gets heated as O’Reilly says let’s go with what the record says and Rivera says he is going with it.  But O’Reilly asked the question everyone wants to know, how does a good mother go to a wet body contest when her child is missing?  Rivera goes with the years of abuse and another bunch of maybe’s, no wonder why he landed the interview with Baez, they both would not stand a chance if there was cold hard evidence and I agree with Bill O’Reilly, the jury did not want to believe the evidence the prosecution provided, the same way that the jury on the O.J Simpson trial did not. Rivera also bought up that if Casey Anthony had gone to church like Andrea Yates than people would not be harsh.  Well Geraldo hate to tell you but when your defense attorney calls you a slut and admits that you are a bad liar, it leaves most of us with a brain wondering how in the world did this woman walk away being found guilty of only lying to the police? Aggravated child abuse?
Richard Hornsby defines Aggravated Child Abuse under Florida’s criminal punishment code and I cannot help but wonder that by Casey neglecting to alert authorities to her daughter’s disappearance she was responsible for her death.  It is known that Caylee died sometime during those 31 days so by not calling 911 isn’t Casey Anthony responsible?
Those who support the ruling made yesterday will continue to stick to the argument that although Casey Anthony was a bad mother there was no proof that she killed her daughter, Caylee Marie Anthony.  Ironically the jury’s decision was made due to lack of hardcore forensic evidence, however I guess just throw out the fact that Casey Anthony did not call 911 when her child went missing.  Or the photographs that proved during the 31 days that Caylee was missing, Casey Anthony was out partying, living it up, the grieving mother even got a tattoo that said “Bella Vita” which translates into “Beautiful Life”.  How does a mother think that she is living a beautiful life when her 2 year-old child is missing?
Unfortunately for the prosecution they failed to provide cause of death, not enough forensic evidence, including no DNA on the duct tape and was up against a family with a questionable mental state.
Why did the prosecution pursue the death penalty?  For people who seemed to cover their bases so well why didn’t they see that coming?

Los Angeles former District Attorney, Marcia Clark appeared on Piers Morgan Tonight saying that the prosecution failed because they had enough to convict her if they had gone the way of saying what Casey Anthony did, rather than arguing whether or not she was the murderer.  By painting the picture that Casey Anthony was the murderer the evidence could have fit. There is a clear distinction between reasonable doubt and a reason to doubt.  Clark went on to point out that the jury took on an elastic concept of reasonable doubt blinded by Baez as he gave them reasons to doubt.  Reasonable doubt is defined by LegalDictionary.com as a standard of proof used in criminal trials. When a criminal defendant is prosecuted, the prosecutor must prove the defendant’s guilt Beyond a Reasonable Doubt. If the jury—or the judge in a bench trial—has a reasonable doubt as to the defendant’s guilt, the jury or judge should pronounce the defendant not guilty. Conversely, if the jurors or judge have no doubt as to the defendant’s guilt, or if their only doubts are unreasonable doubts, then the prosecutor has proven the defendant’s guilt beyond a reasonable doubt and the defendant should be pronounced guilty.
Judge Larry Siedlin also appeared on Piers Morgan Tonight and stated that the prosecution should have pursued manslaughter, which would have provided them with a jury of 6 rather than 12, which is much easier to convince in a case such as this.
Sentencing for Casey Anthony is scheduled for tomorrow in state court, of which Casey Anthony should also be thankful for.  Will Casey Anthony walk free?  It is looking like that may be the case due to the state court laws she will be sentenced under.
